'The things mentioned in the indictment

'were stolen out of the house of the prosecutor

'by two men, who were seen in the

'house by a girl who was gathering in alehouse

'pots; she said, she believed the prisoner

'to be one of those men; but it appeared

'upon the evidence for the prisoner

'that the girl was mistaken in the person.'
