The Prosecutor depos'd that the Goods were stollen, and the Prisoner being taken upon suspicion confess'd the fact, the Prosecutor would not be positive that the door was fastned , so the Jury
acquitted him of the Burglary, and found him Guilty of the Felony to the value of 10 d.
