Lawrence Donolly< no role > Defendt in this Cause maketh oath and saith that at
the General Quarter Sessions of the Peace held in october last for the City and Liberty
of Westminster he this Deponent was Indicted for an Assault on Cornelius York< no role > the
Prosecutor in this Cause and in Janry Session last held for the said City and Liberty
this Deponent Appeared and Pleaded not Guilty to the Indictment And put
in bail to try his Traverse thereon at the last Session of the peace are held for
the said City and Liberty which this Dept intended to do pursuant to the
Condition of the recognizance Enterd into forth at purpose but this Depont
then Applying by affidavit to the said last Mentiond Session of the Peace the
one Ralph Fuller< no role > a material Witness for this Deponent on the Tryal
of the said Indictment was then at Cork in the Kingdom of Ireland the Court
on reading that affidavit was pleased to order that the said Recognizance
Should be respitted until this Present Genl Quarter Session of the Peace
and in order to Try the said Indictment at this Present Session this Deponent
for two months last Past and Upwards has used his utmost Endeavour
(by the most diligent Search in his Power) to findout one John Brasell< no role >
to Give Evidence for this Deponent on the Tryal of the said Indictment
who lived as a servant about Four Months agoe at the Ship and Star
Ale house in the Butcher Row near Temple bar and this Deponent
hath not been able at any time Since the Last Session of the peace to
receive any Intelligence Concerning the said John Brasell< no role >
Except from Bryan Cavanagh< no role > the master of the sd Ale house and
his servants in the said House none of whom Cod Give this Depont
any account of the said John Brasell< no role > till the twenty Sixth infant
at which time And not before this Deponent was informed By the sd. Mr. Cavenagh nor his Servants and
believes the said John Brasell< no role > was Gone to Liverpool in Lancashire
to work in the Tobacco Trade and Expected to return from theme
to London by Michaelmas next and this Deponent further Saith that
the sad Ralph Fuller above mentioned was he has been informed and
verily believes by a letter from him Directed to one Mr. Sullivan Still at Cork
in the Kingdom of Ireland and Expected to return from that place to
London to be Enterd as a student in the Law agt. Michaelmas Term next
This Dept. Further Saith that the said John Bratell< no role > and Ralph Fuller< no role >
