in the
County of Middlesex
-The Above Named Prosecutor Maketh Oath
and saith that he did in June Session 1793 Prefer a Bill of
Indictment against John Atkinson< no role >
the Above Named difendants
For an Assault and which by the Grand Jury was returned A
true Bill-And this Deponent Saith that in April Sessions
last he Moved this Honourable Court to Estate the
above Named Defts. Recognizances-but on the Deft. Atts.
at this Deponent verily deliver Making an Affd. that
this Worshipful Court was Pleased to respite the said
recognizance in the above Prosecution upon Payment
of Costs until this present May Session And this Deponent
further saith that instead of the said Defendant express-
ing any Sorrow or making the smallest Concession for
the Insury done to this Deponent he caused a Note
of Tryal hereto Annexed to be served on this Deponents
purporting that he should take his Tryal in the
said Prosecution this present May Session And gives
out in Speeches and says-that he will put this
Deponent to all the Expences he possibly an
before that this Worshipful Court shall compel
him to take his Tryal in the said Prosecution
and Accordingly countermanded the said Notice of
Tryal as will also Appear by the Notice Marked
No:2 here to Annexed.
