notice was given by the Informer to the driver of the said
Waggon of an intention to complain of such Offence was the
Act of Parliament directs and for that he the Petitioner was
not duly Summoned to answer the said Charge and also for
that the said Justice had not any legal Power or authority
whatsoever by such conviction or order to condemn him in
or require him to pay any costs in addition to the said
Forfeiture and the Petitioner therefore intending to Appeal
Did on the second day of April last give notice in Writing
to the said Nathaniel Bland< no role > Esquire of such his intention
to bring such appeal and the matters thereof and did on the
following day enter into a Recognizance in the Penalty of
Ten Pounds with two sufficient Sureties in the Penalty of
Five Pounds each before Thomas Fellows< no role > Esquire another of
His Majestys Justices of the Peace for the said county of
Middlesex conditioned to try the said Appeal and also to
pay the said Forfeiture in case the said Conviction should
be Affirmed upon such Appeal and abide the Order and
Pay such Costs as should be awarded which said appeal
stood duly adjourned until this Session Now upon
hearing the said Appeal and what hath been alledged by
the respective Parties and their Counsel in and concerning
the Premises It is Ordered that the said Conviction be
and the same is hereby Quashed
