Pretences against the form
of the Statute Etc,
Middlesex
to wit
Richard Macquillin late of Highgate
in the County of
Middlesex
but now a Prisoner in the New Prison
Clerkenwell
in the same County the above named Defendant Maketh, Oath
and Saith that he was not Committed for Trial on this Prosecution
until Thursday last And this Deponent further Saith that he
Caused several Inquiries to be Yesterday made Whether any Bill
of Indictment was found against this Deponent for the above Offence
and this Deponent was Informed and verily believes such Information
to be true that no Bill of Indictment was returned by the Grand
Jury against this Deponent at half Past Six o Clock Yesterday Evening
but this Deponent hath since discovered that a Bill of Indictment
was after that Hour returned a true Bill and of which this Deponent
had no Notice till Nine oClock last Night after such Prison was shut And this Deponent
Saith that he hath not had time to prepare himself for his Defence to
this Prosecution and to Subpand the Persons whose Testimony, he
Conceives Absolutely Necessary to support such Defence and which he
Apprehends he shall be able to do by the next Sessions he therefore
Prays this Honourable Court would be Pleased to Grant him till that
time for that Purpose and more especially as he Conceives such
Indulgence cannot be Attended with any or but little Inconvenience
to the Prosecutor of the said Indictment he the said Prosecutor
having as he has declared Procured a situation in the Victualling
Office at Deptford
and will therefore necessarily be resident there or
in the Vicinity of London
.
