Thomas Trimby< no role > of Crown Court Saint Anns Soho in the County of
Middlesex she above named Defendant Maketh Oath and saith that
he did in October Session last move this Honorable Court in Order to
Obtain liberty to leave notice of Tryal at the Prosecutrix last
place of abode in the above Prosecution And this Deponent further
saith that this Honorable Court was Pleased to grant an Order for that
purpose as will more fully appear by the Order hereto Annexed
And this Deponent further saith that he accordinly served a Copy of
the Notice of Tryal also hereto Annexed by leaving such Copy at her
last place of abode at no 4 Tabernacle walk Moorefields and likewise
returned a Venire in the said Prosecution in Order to have taken
his Tryal in December Session Following and duly attended this Honorable
Court several Days for that purpose And this Deponent further saith
that on the Wednesday the day the Prosn: was called on he diligently
Attended this Honorable Court untill 3 O Clock of the same Day [..]
unexpectedly this Deponent saith that he was called upon his Duty
as a Serjeant in the London Militia at the Artillery Ground in
Moorefields And being informed by his Council that the said Prosn:
was unlikely to be called on that Afternoon that this Deponent
attended his duty accordingly And this Deponent further saith upon
the rise of this Honorable Court on the aforesaid day he was informed
the said Prosn: was called And this Deponent being absent the
Worshipful chairman was pleased to Order the same to be struck
out of the list And this Deponent lastly saith that he has used his
utmost endeavours and made strict search and Enquirey amongst
the friends and those that knew the said Prosecutrix in Order to have
found her out for the purpose of leaveing a Notice of Tryal at
her last Place of abode Pursuant to the Order of this Honorable Court
or personaly to have served her which proved inefectual And further
saith that that he could gain no other intelligence Whatever about
the said Prosecutrix then that she was dead And could not altho
