The Deft. was taken up before a Justice to Answer
at last Session in July, when she was Judd. as above
& appearing with Bail withts. advising wth. a Solls. was
made to plead with seeing the Jnd & Enter into a
Recognizance to have tried now; Being ignorant of
what she did, when she got her Copy of ye. Jnd she
sod. she was not properly named herself not her Husfd.
neither, & wishes to retract that plea & plead a
Misnomer as to her Christian Name & a Misioner
as to her Husband's Sir Name & Addition And therefore
did not take out [..] a Venire nor give any Notice of
Tryal now; the Consequence it seems is that the
Cross. moved on Thursday last for a Bench Warrant
& an Order to give 24. Hours Notice of Bail& obtainedit
please to Move for leave to Retract that plea
& ye she may be at Liberty to pleas speclly. being
totally taken by Surprise at last & thinking she had only
given Bail to have pleaded now, & that her
Recognizance may be respicted & not Estreated & Yt. she
may Enter into a Recogn to Prosocute her sperl. plea
& that such Bench Warrt may be realled & not
Executed; she not havs. yet been taken thereon
