in the County of Middlesex
Gentleman
maketh Oath and saith that he this Deponant was
bound in a Recognizance together with one William Watson< no role >
(since
deceased) for the Appearance of the above named Defendant William
Long< no role >
at September Session last past And this Deponant Further
saith that the said Defendant Patrick Mc. Connaught gave Notice
of Tryal to the Prosecutor William Long< no role >
for the said September.
Session last past and in pursuance of such Notice appeared and
Tryed his Traverse and after the Evidence was given Mr.
Silvester who was Council for the Defendant Patrick Mc. Connaught
advised the Prosecutor and the Defendant Mc. Connaught to shake
hands and take a Chew of Tobacco together and let all matters.
in difference between them be at an end and pursuant to such
advise of Mr. Silvester a Person in Court presented his Tobacco
Box and both parties shaked hands and took a Chew of Tobacco
And this Deponant at that time understood it was by the Consent
of this Honble Court as well as by the advise of Mr. Silvester
otherwiseand therefore apprehended that all matters in difference
between the parties then ceased and at an end otherwise he
should not have suffered his recognizance to stand Estreated as
appears by the annexed Letters or in any way stand in Contempt
of this Honble Court
