the said James unlawfully did seize take and

certain Gun charged with Gun powder and divers
leaden shot did present to at and against the
said James Rossiter< no role > with a wicked intent him the
said James feloniously to kill and Murder on the
27th Janry last anor Count for violently assaulting
the said James and taking away the said Horsecet
and one other Count for a common Assault on the
same day
