The Impt. is recnd.

The King Coomes Coomes was Indd. for a nuisance in not uponing a
Bridge applicats; was made by Mr. Heworth of Cousel for the
Prosecution for a Bench Warrant, I doubted whether in a
prosecutor of this Kind a Bench warrant should issue
in the first instance or whether the prosecutr. should not
proceed by way of Vefa. Upon referring this matter to the
Court for this opinion Sir John Hawkins< no role > delivered the
opinn. of the Court. That tho' originally and strictly the
old process of Vefa Etc should be in all cases pursued; and he wod the opina. of Coke aj. Warrants yet
as the practice of issuing Bench warrants has obtained for a long time and is
become general, and great inconvenience might in use
from a riged observance of the old process, therefore at
a Bench warrant go against the Deft.
