knowing the same to be purloined or Embezzled That the said William
Nichols
< no role > and Elizabeth Hilliard< no role > was upon the Testimony of the said Elizabeth
Pidgion
< no role > convicted of the said Offence but did not receive any Corporal punishment
or pay, any fine or give Bail to appeal to this Honourable Court in pursuance of
the said Conviction as by the Statute in Such case is required That the said
Silk of or for which the said William Nicholls< no role > and Elizabeth Hilliard< no role > were
Convicted of buying and receiving of the said Elizabeth Pidgion knowing the
same to be purloined or embezzled was the same Identical Silk for which the
said Elizabeth Pidgion paid to the said William Hopkins< no role > a pecuniary
Satisfication as before set forth That the said William Nichols< no role > and Elizt. Hilliard
or one of them so being persons no ways employed in any Manufactory of
Silk or any Branch or part of such Manufactoryof Silk or any Branch
upon the Solliciation of the said William Hopkins< no role > did depose as the Petitioner
believes before the said Justice that they the said William Nicholls< no role > and Eliz
Hilliard or one of them sold the said Such so as aforesaid embezzled by the
said Elizabeth Pidgion (and for which the said Elizabeth Pidgion had made
satisfication to the said Willm. Hopkins and which she had before sold unto them
the said William Nicholls< no role > and Elizabeth Hilliard< no role > or one of them and which
Offence they the said William Nicholls< no role > and Elizabeth Hilliard< no role > had been
convicted of upon the Oath of the said Elizabeth Pidgion but under which
conviction the said William Nicholls< no role > and Elizh Hilliard or either of them had
not paid any penalty or suffered any Corporal punishment) to the Petitioner
That the Petitioner not being Guilty of the said Offence appealed from the said
Conviction to this Honourable Court pursuant to the Statute in such case made
and provided Which said appeal stood duly adjourned unto this day
Now upon hearing the said Appeal in the presence and hearing of the said
John Staples< no role > Esqr and he consenting by his Counsel to the allowing the said
Appeal It is ordered that the said Appeal be and the same is hereby allowed
and the said Conviction of the said Justice is hereby Quashed.
