Bone in the County of Middlesex Victualler Robert Povey< no role > [..] of the same
Place Servant to Messrs. Smith and Kinnersley Brewers in Oxford Street and
Daniel Hallett< no role > of Little Pultney Street in the Parish of Saint James in the Liberty
of Westminster Gentleman Severally make Oath and Say and first the Deponent
George Cock< no role > for himself Saith That on Tuesday Evening last one Mr. Ashfield an
Atterney that lives in Hanway Yard near this Deponents House called on this
Deponent and Enquired for the Defendant Mr Downie when this Deponent told
the said Mr Ashfield that Mr Downie was then in the House and Saith that
the said Mr Ashfield then addrassed himself to the Defendant and told him that he
was Concerned as Sollicitor in the above Prosecution and that if he meant to give
Notice of Tryal in the above Cause by leaving one at his House would Accept of
it as good Service And this DeponentDefendant Robert Povey< no role > for himself Saith that
he did on the Sixth day of September Instant leave a true Copy of the Notice of
Tryal here unto annexed at the House of the said Mr Ashfield with his Mother
who promised to deliver the same to her Son as he Came home which
wod be sometime that day Saith that the said Notice of Tryal hath not Since
been Counter manded to this Deponents knowledge or belief And this Deponent
Daniel Hallett< no role > for himself Saith that he called at the House of the said
Mr. Ashfield on Sunday Morning the Tenth day of this Instant September when
he saw the said Mr Ashfield and asked him if he or the Prosecutor should attend
at Hicks Hall as this Day to which Mr Ashfield Answered "I shall not Attend or
"be concerned in the Affair as I cannot Afford to do Business for nothing But you
"may consider the Service of Notice of Tryal upon me as good Service as I have
"delivered the Same to the Prosecutor Hawker, or the said, Mr. Ashfield make use
of Words to that or the like purport and Effect
