On an Indictment at the prosecution of
Burnell for an Assault

John George< no role > of Acton in the County of Middlesex Butcher
the abovenamed Defendant maketh Oath that sometime
in the Month of December last he Entred into a Recognizance
[..] Sureties before Henry Lamb< no role > Esquire to answer all
such Compalaints as shed at the then next Session of the
Peace to be holden at Hicks Hall be them and there be
Objected against him by the said Burnett
And further saith that he believes the said Burnett
preferred and found a true Bill of [..] Indictment against
him this Deponent for an Assault and in Consequence
thereof this Deponent applied to the said Burnett
to settle the Matter [..] and accordingly it was compromised
and agreed and this Deponent paid to the said Burnett
one Guinea for full satisfaction of the said Indictment
and further saith that this Deponent being a Stranger
to the mode of uttling matters of this nature did not know
that any things was need ful than to withdraw his
Recognizances and therefore neglected to take a several
Release and make the proper application to this
Honble Court to get and of the Indictment and lastly
saith that she said Burnett is now on
a Journey unto the County and this Deponent is not
now able to procure a several Release in order by
that means to get of the said Indictment
