Journeyman Taylor maketh Oath and saith that being bound to prosecute the said Deft. Ann
Sutton
< no role > otherwise White at the last Session of Goal Delivery of Newgate holden for the said
County, for Stealing several Goods out of the Lodging Room let by Contract to the said Deft
by this Deponent he this Deponent attended on Wednesday the Tenth Day of Septemr. last at
Hicks Hall and preferred a Bill of Indictment against the said Deft. for such Felony which was
found and returned by the Grand Jury about Eleven of the Clock of that Day and that he was directed
to go down to the Sessions House in the Old Bailey immediately to attend the Trial of the said Deft.
And this Deponent saith that he accordingly went to the Session House with his Wife and two other
Witnesses in order to give their Evidence on the said Trial and that he attended there till the Court
broke up and also attended on the next Day being Thursday and also on Friday, and this Deponent
being greatly Surprized that the said Deft. was not called upon her Trial he went into the Court
and made Enquiry in Relation thereto and was informed that the said Deft. was called on her trial
and acquitted for want of this Deponent and his Witnesses appearing against her in the Evening
of the first Day of the said Session and that the Officer that called out this Deponents Name could
not pronounce [..] And this Deponent saith that he verily beleives the Reason of this Deponents
not appearing on the said Trial was occasioned by such Officers Mistake in calling out this Deponents
Name as aforesaid and saith that the same was occasionednotby any Neglect of this Deponent as he attended in the Sessions House Yard
from the time of finding such Indictment till the Court broke uss as aforesaid and humbly hopes that
this Honourable Court will be pleased to Discharge his Recognizance, for if the same should be
Estreated it will be the entire Ruin of this Deponent and his Wife who is almost ready to lye in

holden for the County of Middlesex at Justice hall in
the Old Bailey London on the twenty second Day of
October 1760}
