At the General Quarter Session of the peace of our Sovereign Lord the King
holden for the County of Middx at Hicks hall in St. John street in the County
aforesaid by adjornment on Tuesday the fourteen day of July in the
twenty first year of the reign of one sovereign Lord George the second
King of Great Britain Etc

Uponmehearing of Mr. Serjeant of Councel for RobertHigby
Higley
< no role > & John Higley< no role > Maltsters Appellants against a Judgment and
[..] sentence given by Thomas Burdus< no role > & Peter Elers< no role > Esqrs. two of his Majestys
Justices of the peace for the County of Middx for aforfeiture of eighty one pounds
and ten Shillings mentioned to be incurred by the Appellants for hiding
& concealing from the sight of the Officer a quantity of wetted malt mentioned
in their appeal, It was alledged that Notice was given on the seventh
of July instant to Mr. Edward Whinfield< no role > upon whose information the said Judgment was given that the said Appellants
intended to appeal to this Court onthethis present Tuesday the fourteenth
day of July instant at ten of the clock in the forenoon against the said
Judgment & sentence And It was alledged that the sd. Edward Whinfield< no role > consented that the sd. appeal should bethe Remd the same day: And that the sd. Appellantsdo now accordingly attend this Courtwith their Councel & witnesses do now accordingly attend this Court AndAnd that the said Appellants now attending then Court with them [..] It was further alledged that Mr. Glanvill
had Yesterday being the first day of this Quarter Sessions moved this Court as
Councel for the said Mr. Whinfield without any notice given to the Appellants
and that the same should be heard by this Court on Friday next, And [..]
was prayed And this Court doth accordingly Order that the said [..] Edward
Whinfield
< no role > maydo pay unto the said Appellants or one of them their costs of this
days attendance on this Court with their Councel & witnesses before the
hearing of the said appeal unless the said Edwards whinfield< no role > shedo to
Notice hereof shew unto this Court good [..] cause to the the contrar [..]
