Prosecutrix in this Cause, and her said Husband have been<lb></lb>
parted and lived asunder for several Years past, as in the<lb></lb>
Affidavit hereunto annexed,</p>
<p n="263">That this prosecucon has been carryed on agt. the Deft.<lb></lb>
without any Privity or Direccon of the Husband, and that he<lb></lb>
knows not or ever heard any thing about it.</p>
<p n="264">That the Deft. appeared at the last Sessions and plended<lb></lb>
not Guilty; but since that Sessions, the prosecutrix & Deft.<obscured></obscured>
<lb></lb>
have agreed, and Wittnesses here to prove it, and has also<lb></lb>
executed a Release (in her Husbands absence) to the Defendt.<lb></lb>
Which, tho' not regular in Law, may show the Intencon of the<lb></lb>
Party, and that the party has done us much as<del>what</del>
was in her power<lb></lb>
to doe in this Affair in Absence of her Husband</p>
<p n="265">I is therefore hmbly prsumed that in Case ye Indictmt<lb></lb>
cannot be Discharged; yet the Recognizance of the Defendt.<lb></lb>
may be so far Respited (in this Case) as to save the Baill Etc</p>
