The King againt James Hill< no role >

John Flemming< no role > of the Parish of St: Giles in the Fields
in the County of Middlesex Victualler the Presecutor in this
Cause maketh Oath that on Monday last being the Seventh day
of June instant be this Depont was personally Served with the
notice hereunto annexed and that thereupon this Depont was
obliged to Cause a Brief to be prpared and to have his sollr . to
attend this Court and also to Fee Councel in this Cause expecting
the Dept James Hill< no role > would have brought on the Tryal
pursuant to the Said Notice but this Depontis informed and
beleives that the Defendt. hath not such out a desire for that
purpose nor hath he shown any other Intention to try this
Traverse but that of Causing the Said Notice to be served upon this
Depont. as aforesaid Voq means where of this Depont hath been
Putt to a great Expense of his month besides the Less of his &
his premisses time
