<p n="118">PRESENT,</p>
<p n="119">The King's most Excellent Majesty in His Privy<lb></lb>
Council.</p>
<p n="120">WHEREAS by an Act made in the<lb></lb>
last Session of Parliament, Entituled, An<lb></lb>
Act for the more effectual punishing wicked and<lb></lb>
will disposed <obscured></obscured>
ned in Disguise,<lb></lb>
and doing Injuries and Violencies to the Persons<lb></lb>
and Properties of His Majesty's Subjects, and for<lb></lb>
the more speedy bringing<obscured></obscured>
is to Justice:<lb></lb>
it is (among other Things) Enacted, That if any<lb></lb>
Person or Persons, from and after the 1st Day of<lb></lb>
June, in the Year of our Lord 1723, being armed<lb></lb>
with Swords, Fire Arms or other offensive Weapons,<lb></lb>
and having his or their Faces blacked, or being<lb></lb>
otherwise disguised, should appear in any Forrest,<lb></lb>
Chase, Park, Paddock, or Grounds inclosed with<lb></lb>
any Wall, Pale, or other Fences, wherein any<lb></lb>
Deer had been or should be usually kept, or in<lb></lb>
any Warren or Place, where Hares or Conies had<lb></lb>
been or should be usually kept, or in any High<lb></lb>
Road, open Heath, Common or Down, or should<lb></lb>
unlawfully and willfully hunt, would, kill, de-<lb></lb>
stroy, or Steal any Red or Fallow Deer. or unlaw-<lb></lb>
fully rob any Warren or Place where Conies or<lb></lb>
Hares were usually kept, of should unlawfully<lb></lb>
steal or take away any Fish out of any River or<lb></lb>
Pond; or if any Person or Persons from and after<lb></lb>
the said 1st Day of June, should unlawfully and<lb></lb>
Wilfully hunt, wound, kill, destroy, or steal any<lb></lb>
Red or Fallow Deer, fed or kept in any Places in any<lb></lb>
of His Majesty's Forrests, or Chases, which were<lb></lb>
or should be inclosed with Pales, Rails, or other<lb></lb>
Fences, or in any Park, Paddock, or Grounds in-<lb></lb>
closed, where Deer had b<obscured></obscured>
or should be usually<lb></lb>
kept, or should unlawfully and maliciously break<lb></lb>
down the Head or Mound of any Fifth Pond,<lb></lb>
whereby the Fish should be lost or destroyed; or<lb></lb>
should unlawfully and maliciously kill, maim, or<lb></lb>
wound any Cattle, or cut down or otherwise<lb></lb>
destroy any Trees planted in any Avenue, or<lb></lb>
growing in any Garden, Orchard, or Plantation<lb></lb>
for Ornament, Shelter, or Profit, or should set<lb></lb>
Fire to any House, Barn, or Outhouses, or to any<lb></lb>
Hovell, Cock, Mow, or Stack or Corn, Straw,<lb></lb>
Hay, or Wood, or should wilfully and maliciously<lb></lb>
shoo<obscured></obscured>
at any Person in any Dwelling-House or<lb></lb>
other Place, or should knowingly send any Letter<lb></lb>
without any Name subscribed thereto, or signed<lb></lb>
witha fictitious Name, demanding Money, Veni-<lb></lb>
son, or other valuable Thing, or should forcibly<lb></lb>
rescue any Person, being lawfully in Custody of<lb></lb>
any Officer or other Person for any of the Of-<lb></lb>
fences beforementioned; or if any Person or Per-<lb></lb>
sons should, by Gift or Promise of Money or other<lb></lb>
Reward, procure any of His Majesty's Subjects<lb></lb>
to Joyn him or them in any such unlawful<lb></lb>
Act, every Person so offending, being thereof<lb></lb>
lawfully convicted, should be adjudged Guilty<lb></lb>
of Felony, and should suffer Death as in<lb></lb>
Cases or Felony, without Benefit of Clergy.<lb></lb>
And whereas it is by the said Act further<lb></lb>
Enacted. That for the more easy and speedy<lb></lb>
bringing the Offenders against the said Act to<lb></lb>
Justice, if any Person or Persons should be char-<lb></lb>
ged with being Guilty of any of the Offences<lb></lb>
aforesaid, before any two or more of His Majesty's<lb></lb>
Justices of the Peace of the County where such<lb></lb>
Offence or Offences were or should be committed,<lb></lb>
by Information of one or more Credible Person<lb></lb>
or Persons upon Oath by him or them to be sub-<lb></lb>
scribed, such Justices before whom such In-<lb></lb>
formations should be made as aforesaid, should<lb></lb>
forthwith certify under their Hands and Seals,<lb></lb>
and return such Information to one of the princi-</p>

<p n="122">pal Secretaries of State of His Majesty, His Heirs<lb></lb>
or Successors, who is by the said Act required to<lb></lb>
lay the same as soon as conveniently might be be-<lb></lb>
fore His Majesty, His Heirs or Successors, in his<lb></lb>
or their Privy Council; whereupon it should<lb></lb>
and might be lawful for his Majesty, His H<obscured></obscured>
<lb></lb>
or Successors, to make His or their Order in His<lb></lb>
or their said Privy Council, thereby requiring and<lb></lb>
commanding such Offender of Offenders to sur-<lb></lb>
render him or themselves, within the Space of<lb></lb>
Forty Days, to any of His Majesty's Justices of<lb></lb>
the Court of King's-Bench, or to any one of His<lb></lb>
Majesty's Justices of the Peace, to the End that<lb></lb>
he or they might be forthcoming to answer the<lb></lb>
Offence or Offences wherewith he or they should<lb></lb>
to stand charged, according to due Course of<lb></lb>
Law; which Order should be printed and pub-<lb></lb>
lished in the next London Gazette, and should<lb></lb>
forthwith be transmitted to the Sheriff of the<lb></lb>
County where the Offence should be committed.<lb></lb>
and should, within six Days after the Receipt<lb></lb>
thereof, be proclaimed by him or his Officers<lb></lb>
between the Hours of Ten in the Morning and<lb></lb>
Two in the Afternoon in the Market Places, up-<lb></lb>
on the respective Market Days of two Market<lb></lb>
Towns in the same County near the Places where<lb></lb>
such Offences should have been committed, and<lb></lb>
a true Copy of such Order should be affixed upon<lb></lb>
some publick Place in such Market Towns; and<lb></lb>
in case such Offender or Offenders should not<lb></lb>
surrender him or themselves, pursuant to such<lb></lb>
Order of His Majesty, His Heirs or Successors,<lb></lb>
to be made in Council as aforesaid, he or they<lb></lb>
so neglecting or refusing to surrender him or<lb></lb>
themselves as aforesaid, should, from the Day ap-<lb></lb>
pointed<obscured></obscured>
aforesaid<lb></lb>
be adjudged, deemed, and taken to be convicted<lb></lb>
and attainted of Felony, and should suffer Pains of <lb></lb>
Death as in case of a Person convicted and at-<lb></lb>
tainted by Verdict and Judgment of Felony<lb></lb>
without Benefit of Glergy; and that it should be<lb></lb>
lawful to and for the Court of Kings-Bench, or<lb></lb>
the Justices of Oyer and Terminer, or General<lb></lb>
Goal-Delivery for the County where the Offence<lb></lb>
should be sworn in such Information to have been<lb></lb>
committed, upon producing to them such Order<lb></lb>
in Council under the Seal of the said Council, to<lb></lb>
award Execution against such Offender and Of-<lb></lb>
fenders in such manner as if he or they had been<lb></lb>
convicted and attainted in the said Court of<lb></lb>
King's-Bench, or before such Justices of Oyer<lb></lb>
and Terminer, or General Goal-Delivery respec-<lb></lb>
