Jon Brough< no role > Attorney for Deft. maketh Oath, That he this Depont. did within
halfe an hourafter the Order & direccon of this Court this daytoin this
Cause tender a Guinea to Samuel Rutland< no role > who is the prosecutor in the said
Cause and desired him to give the Deft. a Generall Release, and then [..]
him that the Deft. was ready and willing to give him another Generall Releife
but that the said Samuel Rutland< no role > refused to accept of it, and went his way
And this Depont. further saith that at the same time he tendred the said
Guinea unto the said Samuel Rutland< no role > , Mr. Daniel Under hill who is an Attorny or Sollicitor
at Law for the said Samuel Rutland answered this Depont. that the said Samuel
Ruthand should not take it without costs of Suite at Law which would amount to four or
five pounds an otherwise [..] the said Mr. Underhill would proceed at Law, he
haveing declared against the said Deft in the Court of Kings Bench at the
said Samuel Rutlands Suite, And this Depont. further Saith that a little
time after and by the further Order & direccon of this Court he this Depont.
desired the said Samuel Rutland< no role > to attend this Court, but the said Samuel Rutland< no role >
went away and beleives he said he would not or words to that or the like effect
