Severally make Oath and say, and first this
Deponent
Jacob Canter< no role >
for Himself saith, that Immediately after the
above Indictments had been found against this Deponent
He caused
Briess to be delivered to counsel and took all proper steps for the
Purpose and with Intent of taking his Tryal at the present Sessions upon
the above two Indictments and is advised and believes he hath a good defence
thereto, but this Deponent
Saith that

for this Deponent
on his
defence against the said Two Indictments and without the benefit of whose
Testimony this Deponent is advised and verily believes he cannot with

diligent Search and Enquiry to be made after the said

on his Business
and was Expected to return Home again about the Middle of March and
not sooner, and this Deponent

at the request of the said

in Cock and Hoop Yard
aforesaid
in order to subpena Him for the purpose aforesaid, and this Deponent

on Saturday last on Enquiring for the said

a Person at the House of the said

who was the Maid Servant
of the said
Gabriel Lyon< no role >
as Deponent
believes, that the said
Gabriel Lyon< no role >
was gone to Sunderland
on Business and that at the Time He set off
for Sunderland
aforesaid which was the Fifteenth of February last
left ward with Her that he should not be able to return until about
the Middle of the present Month of March and this Deponent
