For Perjury</p>
<p n="377">In Novr. 1786 Mr Burlton employed Day an Atty to put in Special<lb></lb>
Bail & Defend an Action he had been arrested upon wch was no Sooner<lb></lb>
done than Day persuaded the Bail to take him into Custody on Pretence<lb></lb>
of Surrendering him when they Extorted a Warrant of Atty to Confess<lb></lb>
Judgment to Indemnify them & then let him go,</p>
<p n="378">Mr Day next entered up Judgment Sued out Execon and put<lb></lb>
the Sheriff into posson at <rs type="placeName" id="LMSLPS15100_geo257">Groton House</rs>

where the Deft<lb></lb>
hired and then took him into Custody on pretence of Surrendering him<lb></lb>
& brot. him to London and locked him up at Gillatts the officers in<lb></lb>
Rolls Buildings,</p>
<p n="379">They then came to an Agreement with Mr Burlton that if<lb></lb>
his Brother Edwd. wod. give them his Bond to Indemnify them &<lb></lb>
for their Expences that they wod. withdraw the Execon this was agreed<lb></lb>
to, the Bond was given but instead of withdrawg the Exon they<lb></lb>
proceeded to Sell,</p>
<p n="380">In Hilary Term the two Mr Burltons Moved the Court agt Day &<lb></lb>
the Bail for breach of the agreemt. & upon that Occasion made an<lb></lb>
Affidavit of such Agreement,</p>
<p n="381">In Febry Sessons 1787 Day & one of the Bail Indicted Mr Burlton<lb></lb>
for Perjury at the <rs type="placeName" id="LMSLPS15100_geo259">old Bailey</rs>

from whence they removed it to the<lb></lb>
Kings Bench And at the Sittings after Trinity Term they Convicted Mr<lb></lb>
Burlton by the Perjury for wch the present Indictmt. is preferred<lb></lb>
agt Mr Day.</p>
<p n="382">As this is an Offence of great Attrocity Please to Move for a<lb></lb>
Warrant to apprehend M Day & that he may give forty Eight<lb></lb>
hours Notice of Bail to the Prosecutor And that the Recognizance<lb></lb>
may be taken in a Sum Sufft. to Secure his Appearance<lb></lb>
to take his Trial</p>
<p n="383">NB Mr Burlton has not yet received Sentence And next Term he is<lb></lb>
advised the Judgment will be Arrested.</p>
