London wine porter severally make oath and first this Depont.
Tanfield on his oath saith That the Prosecutor Duixen
having preferred in May Session last past an Judictment for
an assault supposed to have been [..] prosecutor
by this Depont. Tanfield to which [..] Depont. appeared
put in bail & pleased not Guilty and in order to try and travers
the Indictment this Depont. Tanfield Attended with his Witnesses
and his Bail at every sessions and adjourned sessions
since and this Depont. Tanfield & his witnesses was ready for
that purpose but he was not called in Court to his knowledge
or belief and the other Depon Bed well for himself on his
Oath saith that he likewise attended at all or Most of
the sessions passed since the preferring the Indictment as
a witness and that the said Defendt. was not to be the
best of his Knowledge & belief ever called in Court
and both these Depont. say they verily believe the said
prosecutor Did not attend or appear at any of the
sessions sicne the preferring the said Indictment
and the Defendts. pleading thereto
