of this City maketh Oath that he this Deponent on or about the
TwentiethDay of Aprillast took into Custody the said
Michael Conner< no role >
on the Charge of Benjamin Simmons< no role >
for stealing
a Bricklayers Shovell [..] and this Deponent saith that
the said Michael Connor< no role >
was afterwards examined before one of the
Majestrates of this City
and committed to prison for the said Felony
and one John Thomas< no role >
then the Servant of the said Benjamin
Simmons< no role >
was bound by Rewgingance to prefer an Indictment and give
Evidence thereon against the said Michael Connor< no role >
for the said Felony
at the then next Sessions to be held for this City in the Month of
April now last past and this Deponent as also bound by Recogniance
to give Evidence on such Indictment to be preferred by the said John
Thomas and this Deponent saith that the said Benjamin Simmons< no role >
and the said John Thomas< no role >
promised to give this Deponent Notice what Day they intended to
prefer such Indictment at the said Sessions to the Grand Jury in order
that he this Deponent might give Evidence thereon And this Deponent
saith that the said Benjamin & Simmon< no role >
or the said John Thomas< no role >
did
not prefer any Indictment against the said Michael Connor< no role >
at the said
sessions or give any Notice to this Deponent [..]
and this Deponent saith that he always was ready and willing to
have attended at the said sessions in Case any such Notice had been
given taken and for want thereof only omitted to attend and gave Evidence in
pursuance of such Recognizance and that such Omission [..]
