The King on the prosecution
of John Coom< no role > by against
of Benjamin Flather< no role >
for Felony

John Coombs< no role > the prosecution above named maketh Oath and saith
That the above named Benjamin Flather< no role > was committed by the Hight
Conourable the Lord Mayor in order to take his Tryal at the present
session, and this Deponent was bound over to prosecute him for
feloniously stealing a Linen Handkerchief of small value, this Deponent
property, And this Deponent further saith that being unacquainted
with the mode of prosecution he did not prefer any Bil of indictment
though he attended every Day this Sessions at the old Bailey , expecting
he was to have been called by the Court, but met hearing his name
called he yesterday and not before was informed by a person
whose name he does not knows that he should have applied
to the clerk of the array is to have preferred a Bill against the
said Benjamin Flather< no role > which he immediately applied to him to do
but found he was too late the Grand Jury having been discharged
on saturday last
