Benjamin Bird< no role > the Defendant in the above Cause
Maketh Oath and Saith That William Jones< no role > is a
Material Witness on the part of this Deponent on the
Tryal of the Indictment in this Cause and this Deponent
Saith that he has great reason to believe that the said
William Jones< no role > is now at Liverpoole in the County of
Lancaster andthatthis Deponent Saith That on his
being taken up for the Offence aforesaid he this
Deponent wrote a Letter to the said William Jones< no role > to
require his Attendance to give Evidence on the part of
this Deponent on the Tryal of this Indictment at the
next Session he this Deponent being informed and
Apprehending that his Tryal would not come on at
this present Session as he this Deponent was only
Committed for the said Offence on Wednesday last which
was during the time of holding the sd Session which
Letter this Deponent caused to be put into the General
Post in Order to go to the said William Jones< no role > at
Liverpoole aforesaid And this Deponent Saith that
he apprehends and believes that he shall be
Able to get the said William Jones< no role > to Attend and
give his Evidence on the Part of this Deponent
on the Tryal of this Indictment at the next Session
If this Hoble Court will be pleased to purpose
the Same And Lastly this Deponent Saith That
without the Testimony of the said William Jones< no role >
he the said Defendant cannot Safely take his
