Oath that sometime before the last Session of Goal Delivery of Newgate
holden for this City in April last he was bound over to prosecute the
said Deft. for stealing two Spectacle Cases of the Value of two shillings
And saith that he did accordingly at the said Sessions prefer an
Indictment against the said Defendant and give Evidence to the Grand
Jury thereon and the same being found a true Bill and returned into
Court on Thursday in the said Sessions about four of the Clock in the
Afternoon of that Day And this Deponent saith that not expecting
the said Deft. to be tried that Day he went home and came again
to attend the Court on the Friday Morning in the said Session and was
then to his great Surprize informed that the said Defendt. was called
on his Trial on the Thursday Afternoon about five of the Clock and
acquitted for want of this Deponents Appearance And this Deponent
saith that he did not neglect to attend the Court to give Evidence agt.
the said Deft. with any View to favour him
