<p n="20">The Reasons for finding the Indictment on that Commission, rather<lb></lb>
than on the Comission of the Peace, were</p>

To avoid the great Expence & delays attending Writs of Certiorari and<lb></lb>
Procedendo (practices of late much set on foot, by the knowing Sollicitors,<lb></lb>
to obstruct the Course of Justice) and</p>
<p n="22"> <note type="authorial" place="margin">2dly.</note>
<lb></lb>
That the Example of Prosecution, as well as Punishment, might be<lb></lb>
as notorious as the House itself.</p>
<p n="23">Soon afterwards the Defts. being taken up, entered into a Recognizance<lb></lb>
before Colll. De Veil to appear at the next Session; and accordingly in</p>

They Appeared, and having Pleaded, Not Guilty, entered into the<lb></lb>
usual Recognizance to prosecute their Traverse with effect at the ensuing<lb></lb>
SessionBut instead thereof, in</p>

The Defts. having obtained a Certiorari, Signed by the Lord Ch: Justice<lb></lb>
Lee, to remove this Indictment into the <rs type="placeName" id="LMSLPS15055_geo5">Court of King's Bench</rs>

, brought<lb></lb>
the same to the <rs type="placeName" id="LMSLPS15055_geo6">Old Baily</rs>

<interp inst="LMSLPS15055_geo6" type="type" value="undefined"></interp>
to be Allowed; but Mr. Ford suspecting that<lb></lb>
this Writ had been fraudulently obtained, refused to Allow it, and upon<lb></lb>
Enquiry it appeared that the Lord Chief Justice had been Imposed upon,<lb></lb>
for which the Clerk in the Crown Office who issued the Wait, was<lb></lb>
Dismist.</p>
<p n="26">The Defts. finding themselves thus disappointed, moved the Court<lb></lb>
to Put off the Trial till the next Session, from an Apprehension (Sworn to)<lb></lb>
that their Certiorari would have been allowed; with which reason the<lb></lb>
Court being dissatisfied, refused to put it off; but afterwards the Court<lb></lb>
making a General Adjournment of all the Traverses on the Oyer and<lb></lb>
Terminer Commission, this went off with the rest.</p>

The Defts. made Default, whereby the Recognizance so entered into<lb></lb>
by them in Octor. Session, became Estreatable, and they themselves again<lb></lb>
subject to the Magistrate's Warrant, had not the Prosecutor himself<lb></lb>
brought a Certiorari.</p>
