the Prosecutor in this Cause maketh Oath that<lb></lb>
the Deft having given Notice last February Sessions for trying<lb></lb>
this Indictment he the Same Sessions obtained an Order for<lb></lb>
putting of the tryall to the next Sessions addal the next<lb></lb>
Sessions the Deft. gave notice of Tryall but did not<lb></lb>
Surrender in lane and thereupon the Court was pleased to<lb></lb>
order his Recognizance to be estreated But on his<lb></lb>
application afterwards the Court was pleased to respit his<lb></lb>
Recognizance untill this present Sessions upon his<lb></lb>
payment of Capt But the Defend never drew up the Said<lb></lb>
Order he had to obtained but the Same was draw up<lb></lb>
at this Depts. expence & on this Depts. Sollicitation the<lb></lb>
Costs were taxes but the Deft. did not pay the Said Costs<lb></lb>
untill this Morning as this Dept. was coming to Court altho this dept hath caused he Same to be demanded<lb></lb>
of the Deft. and this Dept Saith that he hath been<lb></lb>
putt to more than ordinary expence & trouble in the<lb></lb>
prosecution of this matter occationed by the Defts delays<lb></lb>
he this Dept. having from time to time attended with eighteen<lb></lb>
witnesses necessary as this Dept is informed & beleives<lb></lb>
for the tryall of this Cause One of which Witnesses is a<lb></lb>
Gentlewoman who this Dept at Great expence brought<lb></lb>
from Bath and the being<obscured></obscured>
eldy & unfitt for travelling<lb></lb>
lie this Dept hath Dept her in town ever Since February<lb></lb>
Sessions for the purpose of her Evidence in this Cause And<lb></lb>
this Dept. Saith that the Deft. gave notice of motion this Sessions to put of this tryall and this Dept<lb></lb>
attended with his Councell<obscured></obscured>
to oppose the Sd Motion<obscured></obscured>
the said Motion was not made nor a<lb></lb>
Countermand given untill after time appointed was over</p>
