Oath that he verily believes the Apparation made to the Court by the Petitioner<lb></lb>
touching the Party Wall between the Deponents <obscured></obscured>
and the Petitioners house<lb></lb>

occassioned by an Agreement that has been lately made between the Petitioner and<lb></lb>
Mr Looni for building of a new house to be adjoining to the said house of this Deponent<lb></lb>
and within View of Gaining (if he can prevail in Getting an Order for pulling down<lb></lb>
this Deponents Wall) a Considerable Number of Fleet to the Enlaseying the Petitioners<lb></lb>
house and not out of any Apprehension of the said walls being ruinous or ready to full<lb></lb>
And this Deponent is in<obscured></obscured>
so to believe because this Deponent has at the Request<lb></lb>
of the Petitions met the said Petitioner Three severall times touching the said party<lb></lb>
Wall at one of which times the Petitioner to let this Deponent that the Persons who<lb></lb>
were to build his house had signed Articles with him a net that he could oblidge them<lb></lb>
to perform their Articles with him, which he said could not be done without pulling<lb></lb>
down the said Party Wall or used Words to that Effect and he further said that by pulling<lb></lb>
down the said Wall he should Gain a Considerable Addition of Ground the old Wall<lb></lb>
being as he said, above Thirty Inches Thick and by the Act of Parliament they<lb></lb>
were not Obliged to make the new Wall above Eighteen, and he proposed to have what<lb></lb>
Ground worth be Gained thereby entirely on his Side, and this Deponent further<lb></lb>
Saith that upon Enquiry and Examination made by Surveyors that have been since<lb></lb>
Employed by the Deponent to Survey the said Wall the same is from the Foundation<lb></lb>
thereof to about a Yard high (as this Deponent has been informed by the said<lb></lb>
Surveyors and easily believes) above Fifty Inches Thick: And from thence Four<lb></lb>
Foot higher; the same is about Forty three Inches Thicks and from thence to the<lb></lb>
<obscured></obscured>
of the next stairs is Two Bricks Thick; And this Deponent dues verily believe<lb></lb>
from the Information of the said Surveyors that the said Wall is very Substantiall<lb></lb>
and would stand for a Great Number of Years for which Reason this Deponent<lb></lb>
does verily believe the Petitioners Application to this Court does proceed from the<lb></lb>
above mentioned Justises and no other. And this Deponent saith that he<lb></lb>
neither directly or indirectly ever influenced or endeavoured to influence or<lb></lb>
requested the Surveyors appointed by this Deponent to Survey the said Wall with the<lb></lb>
Petitioners Surveyors not to sign any Certificate touching their Judgment and<lb></lb>
Opinion of the said Wall And this Deponent verily believes that they never did<lb></lb>
refuse to sign a Certificate but only the Certificate as Drawer by the Petitioners<lb></lb>
Surveyors, which they refused as this Deponent believes, because it was Contrary to<lb></lb>
their Judgment and from other Reason whatsoever And this Deponent further saith that<lb></lb>
he had no notice of the second Appointment Given by the Petitioner till Saturday the<lb></lb>
Twenty first of June last, between ten and Eleven of the Clock at Night which was<lb></lb>
then last at this Deponents house in the County upwards of Sight Miles distant from<lb></lb>
London so that this Deponent had only Monday to Come to know to Town and look for<lb></lb>
