N B:

Wm. Pitt< no role > is the Keeper of Newgate admitted by the
Court of Lord Mayor and Aldermen and he for some time
past has retired into the Country and left the sole
Managemt of the Goal to Thomas Allen< no role > his Servt or
Underkeeper who gives him Security to indempnify
him

Q Whether in this Cafe any and what Prosecucon
in advizeable and agianst whom sack Prosecucon
shall be carried' on

upon perusing the Report of the Committee of the Court of Adlermen appointed
to enquire concerning the Escape of Fisher & Johnson, & the Affidavits
thereunto annexed, I concieve some circumstances appear sufficient to induce
a belief that the said Escape happen'd by the connvence of Allen the
Under -keeper; But however I cannot think it advisable to commence
prosecution for a voluntary Escape; but am of opinion that there is
sufficient foundation to charge Mr. Pitt the Keeper either by Indicmt.
Information with two negligent Escapes, & after he shall have been
convicted thereupon it may deserve consideration what further proceedings
may be made, since severall negligent Escapes will amount to a forfeiture
of the office. It sams moreproper to prosecute Mr. Pitt himself than Allen
[..] he being litte for the neglect of his Deputy or Servant in
at Custody of prisoners, & it doth not appear whether Allen be strictly
Deputy or only a Servant
