Walter Jeanes< no role > of ye parish of St Sepulchre London Gent maketh Oath
That Patrick Turner< no role > & William Johnston< no role > are material Witnesses for
the Deft. Jameson in this Cause to disprove the Testimony of
Peter Nicholson< no role > the Chief Evidence of the prosecutor in this Cause
againdt ye Deft. Jameson For that to this Depoents Knowledge
the sd Patrick Turner< no role > & William Johnston< no role > were prsent at several
of yt transaccons & circumstances to which ye matter wherewith
the sd. Richelson hath Charged ye Deft. Jameson relates & are able
to pve the same to be other wife than what the sd. Nicholson hath
sworn in his Informacon relating to ye fact forwhich ye Defts now

stand

Indicted, and that also ye sd Nicholson is a very stand alone Pson
of no Creditor reputacon And this Depont. further saith That ye said
Patrick Turner< no role > & William Johnston< no role > [..] being
Travelling Chapmen or Trading men are now in ye Countrey upwards
of Fifty miles from London as this Depont. is informed & verily
believes for that this depont. hath made diligent enquiry after
them in order to serve them with as suspence to Testify on ye Defts
behalf but could not meet with or find them at ye prsent but that
they are expected to come to London within these Three weeks And
this Dept. futher saith That Thomas Smith< no role > one of the Defts in this
Cause is now under an Arrest at the suit of Richard Reddis in the
Custody of one Powell an Officer at Southwark in ye County of
Surry, haveing been taken or arrested by ye sd Officer in the
afternoon of the Fifth instant And the said Officer still
detains hins the said Smith a prisoner & refuses to take Bail
which induces this Depont. to believe ye same to be done by the
Contrivance of ye Prosecutor or his Agents to prvent the said
Smiths appearance in this Honourable Court according to
his Recognizance.
