James Russell< no role > a prisoner in the Fleet prison for
debt maketh oath that on Tuesday evening Dept saw
the deced and David Williams< no role > quarrelling together, & he
heard the deced charge Williams with having beat over the
Wall balls belonging to another person and not paying for
them, and many words passed between them respecting some
persons playing at Racquets, and they called each other abusive
names. That then a prisr. named Calvert came up to the deced
& abused him and words passed between them, during which
Williams sayed to the deced if he would not take him to the
Gate he would give him a good hiding, meaning beating, to which
the deced [..] answered that he certainly would take him to the
Gate if he touched him. Calvert at this time advanced towards
the deced in a menacing posture and using ill language towards
him which occasioned the deced to retreat a little backwards
That Williams was behind the deced & but a short distance from
him and Williams sayed to the deced Damn you do not tread
upon my Toes, I have got Corns, or something to that effect; at this
time the deced was about a foot distance fromtheWilliams, as
this Dept believes, and whether he trod upon his Toes or not
Dept does not know, but Williams shoved the deced from him
with his elbow in a manner as it occurred to Dept as if he
had trod upon his Toes, and immediately afterwards he struck
the deced upon his face and Temple, three or four blows as he
believes. That the deced did not attempt to return the blows
but turned aside, and Dept ran for a Towel to wipe the deced,
for [..] a great deal of Blood issued from his Mouth &
nose, but when Dept was returning he met several persons
bringing the deced up Stairs to his room. Says the deced then
appeared to be in a senseless state. That he was taken up to
his bed and remained in a senseless state until between
7 & 8 the next morning when he died.
