Patrick Leeson< no role > of Titchfield Street Saint
Marylebone in the County of Middlesex Esquire the
Defondant above named Maketh Oath and saith That in
May Session last this Deponent Pleaded to the Indictment
preferred and found against him for Assaulting the
above named Prosecutor and put in Bail to try his
Traverse at this present Session And this Deponent
saith That Francis Gradey< no role > late of the Parish of Saint
Giles in the Fields in the County of Middlesex Labourer
is a Material and Necesary Witness for this Deponent upon the
Trial of the said Indictment and without whose testimony
this Deponent is advised and Believes he cannot safely
Proceed in the Trial thereof And this Deponent saith
That he has for this several Days last Past made
diligent Enquiry after the said Francis Gradey in order the
have him Subpeenad upon the said trial but this
Diponent is Informed he is gone to Ireland and will not
return for a Month which Information this Deponent
believes to be true And this Deponent lastly saith That
he did not give Notice of Trial for this Session on
account of the said Francis Gradey< no role > 's Absence but he
hopes and believes he shall be able to Procure the
Attendance of the said Francis Gradey< no role > by the next
Session to give Evidence for him upon the said Trial
