The King on the prosecution of Henry Smith< no role >
against
Ann Wood< no role > and James Smith< no role > }
for an
Assault.

Henry Smith< no role > of Newman Street in the Parish of
Saint Mary lebone in the County of Middlesex Gentleman Maketh
Oath and Saith that he did employ Mr Livingston Attorney at
Law as his Sollicitor on the [..] above Indictments, and
trusted that he would not only take out the Venire, but
likewise take out Subpeenas to Subpeena his Witnesses previous
to the Sessions but has been Informed that the said Mr
Livingston has Neglected not onlyNeglectedto sueout the
Subpeenas until Friday last but has also Neglected to serve
the Witnesses in proper time by which means he is deprived of
the Testimony of his Witnesses And this Deponent further Saith
that Miss Thompson whose Christain Name this Deponent doth
know and who Resides at No 14 Union Street and also a Servant
Maid who lived with the said Ann Wood< no role > above Named, and
whose Name Deponent doth knord are both Material Witnesses
on his behalf and whom this Deponent and directed his Attorney
Mr Livingston to Subpeena are not now to be found or Served in
time to Attend the Trial of the above Indictments and that he has
Caused Inquiry to be made by his Servant Maid at the House
where the said Miss Thompson Wides, but who was Repeatedly
denied so that this Deponent had never an Opportunity of seeing
