On an Indictmt. for an Assault & Articles
of the Peace upon the prosecution of
Sbriel

Frances Brooke< no role > of Kensington in the County of
Middlesex Wife of John Brooke< no role > the Defendant
above named maketh Oath and Saith that
the said John Brooke< no role > or not at present in
England to her Knowledge or belief but as she
verily believes is abroad in North America
as Deputy Chaplain to one of his Majesty's
Regiments there, She this Deponent having in
the Month of November last received a Letter from
the said John Brooke< no role > dated Hallifax Nova Scotia
Augt. 14th. 1757. And this Deponent Saith that
She does not know when the said John

< no role > will return to England

Be pleased to move the Court at Hicks's Hall to morrow
in the forenoon to respite the Deft's [..] & his Bail's
Recognizce upon the above Affidt. It was respited for
the last Qur Sesss. till this, but wod have the Motion
now made to respite it till Deft's Return, his Bail
undertaking to produce him when he do's return; If the Court
will not grant it, the Motion must then be for a Respite
till next Qur Sesss. but shod. caller it wod. be the other way
you can get it so, the attending every Qur Sesss. being not only
expensive, but very troublesome
