much of the said Report as last abovementioned be confirmed and the same
is hereby ratified and confirmed accordingly

The said Committee Further Report That
having taken into Consideration Mr. Elmores account of Fees due to
him from the County under the Act of Parliament abovementioned
the Committee Postpones the Consideration of the same

The said Committee Further Report That
having taken into Consideration an Act of Parliament passed in
the fourteenth Year of his present Majestys Reign Intituled An
"Act for the Relief of Prisoners charged with felony or other Crimes
"who shall be acquitted or discharged by Proclamation respecting the
"Payment of Fees to Goalers and giving a Recompence for such fees
"out of the County Rates" It appears to this Committee by the said
Act that every Prisoner that now is or hereafter shall be charged
"with any Felony or other Crime or as an accessary thereto before any
"Court holding Criminal Jurisdiction within that part of Great
"Britain called England and Wales against whom no Bill of
"Indictment shall be found by the Grand Jury or who on his
"or her Trial shall be acquitted or who shall be discharged by
"Proclamation for want of prosecution shall be immediately set at
"large in Open Court without the Payment of any Fee or Sum of
"Money to the Sheriff Goaler Keeper of the Goal or Prison from
"whence he or she shall be so discharged and set at Liberty for or
"in respect of such discharge

And it Appearing by the said Act that
all such fees as have been usually paid to the Sheriffs Goalers or
Keepers of Prisons are Abolished That the Treasurers of the several
Counties shall on Receiving a Certificate Signed by one or more Judge
or Justice before whom a Prisoner shall have been discharged pay
out of the Rates of such County to such Goaler a Sum not Exceeding
Thirteen Shillings and Four pence in lieu of such Fees due upon
the discharge of every prisoner as aforesaid

The Committee are of Opinion that all Indictable
Offences are within the meaning of the said Act Vizt. Treasons
Felonies Assaults Riots Misdemeanours & Indictable Nuisances
