recomend, they are then

St.

To convict them of Selling Drink without licence, and to
levy to the use of the poor of the Parish the penalty of
Twenty Shillings incurred thereby, But the Referrees are
of Opinion that it is necessary that Such Conviction should
be drawn upp in form and retorned to the next Sessions
(Whether the same shall be a generall or Quarter Sessions)
altho' Such retorn be not expressly required,

2dly.

If they continue to Sell Drink without licence; To Convict
them again, whereby they are made lyable by this
Statute to one Months imprisonmt. in the house of Correcton
& there to be dealt with as lewd ible and disorderly persons
But this Second Conviction must be also drawn up in
form and retorned to the next Sessions

3 dly.

And if they Still offend in like manner to convict them
a third time, Which will make them lyable to be comitted
by the Justice or Justices convicting and to remain in the
house of Correction untill by Order of the Justices at
Sessions they shall be delivered from thence And one
Justice may execute this Act, But each Conviction must
be made on view Confession on Oath of two Witnesses.

But as the Referrees conceive all these Convictions are
necessary to be drawn up & retorned to the Sessions in forme
In regard the Sessions cannot otherwise take notice that
the party hath been convicted before, and therefore cannot
execute the powers given them on the third Conviction,
It is proposed that proper formes of these Severall
Convictions be prepared by the Clerk of the peace and
delivered to the Clerk of every Division who attends
the Justices at their Special Sessions and likewise a proper
forme of a Certificate or Return of the Recognizance &
Offence on the said Statute of 5 & 6 Ed. 6 C. 25th.

If all these methods prove insufficient Then the neighboring
Justices may cause them to be prosecuted or Indicted (at
the expence of the parish) for keeping disorderly houses, and
have the Bills found on the Oyer, whereby on Conviccon
