at the Session
holden in December last, for Stealing 4 Shillings from
him He preferred a Bill Indictment which was
formd & returned by the Grand Inquest the Second Day
of the Session about two of the Clock in the afternoon
when as soon as he had been dismissed by the Grand
Jury he went home to dinner, intending to Return
after he had dined to look at the List at the Gate
to inform himself then whether there would be
any likelyhood of its' coming on that afternoon,
(not much expecting it would) And this Deponent
further Saith that as soon as he had Dined and
went on a small Matter, of Business of his Masters
(being only a Servant

) he repaired to the Session house to Inform
himself as aforesd. and attend the Tryal of the
said Deft. if necessary When to his great Surprize
he found that in less than a Quarter, of an born
after his sd. Departure the Tryal was called
on and for want of his appearance and the
Theft being Small the said Deft. was Acquitted
and Discharged And this Deponent saith he was
then & still is very Sorry for the Sd. Event
And that he did not absent himself wilfully
or designedly to Avoid giving Evidence or, to
favour the Said Deft. in the least but merely on
the afroesd. occasion And his Apprehension that the Sd.
Tryal wod. not come on so Suddenly after, the finding the Bill
Sworn at Justice hall
the 26th. of October 1757.
