Attorney for the prosecution in this Cause And David Wedderburn< no role > of
the same place Gentleman severally make Oath and say And first
this Deponent Nathaniel Spry< no role > Saith That Thomas Lockey< no role > of
Sun Street without Bishopsgate London Joyner is a very
Material Witness in this Cause on the behalf of the prosecution
And that the prosecutors thereof cannot as he this Deponent is advised and
verily believe safely proceed to the Tryal of this Indictment without the
Evidence of the said Thomas Lockey< no role > and that he hopes and belives he shall
be able to produce the said Thomas Lockey< no role > as a Witness in this Came at the
next generall Quarter Sessions to be holden in the Month of December
next And this Deponent David Wedderburn< no role > Saith that he this Deponent
hath for this last Week past by the directions of the said Nathaniel Spry< no role >
used his utmost endeavours to serve the said Thomas Lockey< no role >
with a Subpena to give his Evidence on behalf of the prosecution
of this Indictment upon the Tryal thereof at this present Sessions
and for this purpose he this Deponent hath made diligent Enquiry
after the said Thomas Lockey< no role > at the House of one William
Boswood
< no role > at No. 35: in Sun Street aforesaid at which House the
said Thomas Lockey Lodges but saith that he was there informed
by the said William Borwood< no role > and his Wife at diverse times and
particularly on Fryday last, and he verily believes such Information
to be true that the said Thomas Lockey< no role > about a fortnight ago
went into the Country and at the time of his going away left word
with the said William Boswood< no role > and his Wife that he was going
into the Country and should return in about three Week but was not
then returned home and that they declared they could not tell this [..] where
he was gone
