one of the Defendants
in this Indictment maketh Oath and saith that one John Parrett< no role >
this Deponents late Clerk is a very Material Witness for this Deponent
in his Defence to the said Indictment without whose Testimony he
this Deponent cannot safely proceed to try this Traverse And this
Deponent saith that in or about the Month of May last the said
John Parre< no role >
left this Deponents service and is lately gone into
Lancashire
or Yorkshire
as this Deponent hath been Credibly Informed
and verily believes and this Deponent hath made Enquiry after &
Done his Endeavour to find out what Particular place the said John
Parre is gone to in order to produce him at this present Sessions
but has not as yet been able so to Do but saith he this Deponent
will use his utmost Endeavour to Subpana him against the next
Sessions which he verily believes he shall be able to Accomplish
And this Deponent further saith that he Does not mean to Delay
the Prosecution of this Indictment on any unfair Pretence
whatsoever, but for the reasons aforesaid; On the Contrary this Deponent
is Determined (if Possible) to try the said Traverse to the said
Indictment and to make the best Defence he can thereto at the
next general Sessions of Oyer and Terminer for the City of London
to be held at Justice Hall
