Cleydel Courteen< no role > one of the Defendts. in this Cause, and Jacob Bonner< no role >
of London Mercht . Severally make Oath and say, and first the
sd Cleydel Courteen Sayth, That he being a Member of the
Company of the Mine Adventures of England was present at a
Generall Court of the said Company hold at Stationers Hall
London on or about the twenty second day of December 1721 and
that the said Company then came to Several Resolutions or Orders
some Whereof this Deponent believes to best the effect following
Vizt. a Motion being made for appointing a Committee of Seventh
Persons being members of the said Company for the Year then
ensuing, Seven whereof to be a Quorum to prosecute the Suits
depending in the High Court of Chancery between the said Company and
the Exsd. of Mr. William Waller< no role > and Mr. Anthoney Forty< no role > , And to prosecute
any other Suck as they should think fitt, And that they should be
farnished with all the persons for the service of the sd. Company, as the
former Committee of Seventeen of the said Company had: on
the Question put, it was carryed in the Affirmative, and therefore
the said Company proceeded to the Choice of the said Committee by
Way of Ballott and Nathaniel Careton< no role > (one of the Scrutineers
appointed to Examins the Lists) reporting that the sd Sr. Humphrey
Mackworth and others had the Majority of Votes, the sd Company
on Such Report Resolved that they were daly elected to be the sd
Committee for the purposes aforesaid, and this Desonent further
sayth, That he having perused the Minutes and Resolutions of
the sd. Company made in Generall Courts held the Year 1720 Doth
find, that the former Committee were impowered to do all such Matters
and things, as they Should Judge to be for the Good of the sd Company
and to make and conclude any Agreement or Agreemts for their
Service and to Affir the Corporation Seal thereto or to the Effect and
the sd Deponent farther Sayth that on or about the 23d of this Just
April he went to the Nine adventurers Office in Carsitors Alley
and then in the presence of the said Jacob Bonnet and Mr Witcher
