Perjury on the Prosecution
of Samuel Baylis< no role > .

John Staite< no role > of Cundicote in the County of Gloucester Gentleman
the abovenamed Defendant and John Lucas< no role > of Shudeley in the
said County Gentleman severally make Oath and say And first this
Deponent John Staite for himself Saith that the Indictment found
against him on the Prosecution of the said Samuel Baylis< no role > is grounded
upon an Affidavit made by this Deponent upon an Application to
his Majestys Court of Kings Bench in a certain Cause there depending
wherein the said Samuel Baylis< no role > is Plaintiff and this Deponent is the
Defendant And this Deponent Saith that such Affidavit was
made Relative to a Writ of Caprius as Satisfaciendum which had
been Executed upon this Deponent at the Suit of the said Samuel
Baylis
< no role > wrongfully as this Deponent Apprehended & believed And
this Deponent further Saith that a Rule to shew Cause was granted
upon such Application and the matter came on before the said Court
upon Affidavits as well on the part of the said Samuel Baylis< no role > as
on the Part of this Deponent And the whole was referred to the
Master of the said Court to Consider and make a Report as this
Deponent has been Informed and believes And this Deponent
Saith that in Consequence of such Reference the said Master has
certifyed that the sum of One hundred and Nineteen Pounds or
there abouts should be Paid back to this Deponent by the Sheriff of
the County of Gloucester in whose hands the sum Three hundred and
Seventeen pounds One Shilling and Six pence was deposited in
discharge of the said Writ of Caprius as Satisfaciendum and a Rule
of the said Court of Kings Bench was Accordingly made for the
Sheriff to return the same as this Deponent has been Informed
and believes by Mr Cotterall Attorney at Law at Campden in the
said County of Gloucester who Acts for this Deponent as such in
the said Cause And this Deponent further Saith that Mr John
Rigg
< no role > of the Temple who is Agent for the said Mr Cotterall and
was Concerned for this Deponent as such in the said Application
to the said Court of Kings Bench and is likewise Concerned for
this Deponent in defending him against the present Indictment
and had directions for that Purpose and to Prepare for the
Trial thereof and which he Promised this Deponent he would
take Care in should be done wrote to this Deponent sometime in July
last to be ready against the Fourteenth of this Present September
with Witnesses in Order to Try the said Indictment And this Deponent
Saith that relying upon the said Mr Riggs Care in respect to this
Deponents Defence and that the said Indictment would be tryed he
came out of Gloucestershire to London on Tuesday last with his
Securities and one Witness in Order to Appear and Attend at the Tryal
of the said Indictment in Pursuance of the said Letter and upon
this Deponents coming to Town he went to the said Mr Riggs
Chambers in Order to have Acquainted him therewith and to have
prepared Council on this Deponent behalf but was then Informed
by a Person in the said Mr Riggs Chambers that Mr Rigg was in the Country
