Thomas Francis< no role > of Lincolns Inn in the County of
Middlesex assistant Sollicitor of his Majesties Treasury Maketh
Oath and Saith, That he this Deponent on Wednesday night last
and not before received from Sir Robert Henley< no role > Knight his Majesties
Attorney General Directions to prosecute at the Expence of the Crown
Michael Sullivam< no role > and John Mcleary< no role > who were committed some
time since by George Wright< no role > Esquire for Enlisting men into Foreign
Service and who are now as this Deponent is informed detained in
Newgate upon the same Commitments and this Deponent Saith
That at the times he received such Directions form the Attorney
General he was informed by the said Attorney General that the
Directions for prosecuting the said Sullivam and Mc. leary were
not sent to him the said Attorney General form the Secretary of
State till that day and this Deponent also Saith that Mr:
Attorney General at the same time ordered this Deponent to
make the proper Application to this Honourable Court to
detain the said Sullivam and Mc. leary till the next Sessions
for that it was impossible for him to be ready to try them this
present Sessions on Account of his not having received Directions
for that purpose sooner and for that some of the principal
Witnesses for the Crown were Solicitors in Lord Robert
Manners
< no role > 's Regiment which was then Quartered at Dover
in Kent and without whose Evidences the Crown could not
with safety proceed to the Tryal of the said Sullivam and
Mc. leary

Sworn at Justice Hall in the
Old Bailey in the Suburbs of
the City of London the 25th.
of January 1757 .
