And further that whereas by his Lease he ought to have
Laid out five Hundred pounds in Building a New Brick
House in some part of the uplands within the First Seven
yeares which Expired at Michas 1708 but hath not yet done
any thing towards it Wee are of opinion that in respect of
the Charge he hath been at in fitting up and repairing the old
house scituate in the Marsh and makeing the same fitt for
Habitacon which He alledged to be of much more use to him
then a house in the uplands can be Soe may be permitted
to Doferr the Building of the said House (if he thinks fitt) till
Lady day 1716 He forthwith giving security to be approved
by the Grand Comittee that ye same shall be built within one
year after that time and the said full sume of Five Hundred
pounds Expended therein and likewise Agreeing to make
such repaires to the Foundacon of the aforesaid old Marsh
wall as the said Comittee shall think needfull for the Secureing
of the intended fore land till the same and the said new wall
shall be judged to be well fixed and setled.

And wee recomend it as absolutely necessary that views
should be made upon the said new wall and the foundacon
of the old wall once in Two yeares or oftner during Mr: Collyer's
Lease

And Lastly wee find that all the Land lyes in good Order
and that all the Buildings are kept in good repaire
And whereas Mr: Collyer by his Covenan to ought to have
planted one Thousand trees of oak ash or Elme and also an
orchard with good fruite Trees and to maintaine & recruite the
same Wee find that he hath planted an Orchard adjoyning
to the Marsh house which is in a Thriveing Condicon but
that the Oake Ash and Elme Trees planted by him in severall
parts of the Uplands are farr short of the Number he was
oblidged to plant and are for the most part so small that they were
not fitt to be planted there and many of them are already
dead and few like to thrive and therefore wee are of opinion
that he ought forthwith to plant other and better trees in
the Roome thereof and compleat the Number.
