The King agt. John Hardiman< no role > on the prosecution
of Mathew Swift< no role > and others for a Misdemeanor.

John Hardiman< no role > of Upper Rathbone Place in the
Parish of Saint Mary le bone in the County of Middlesex Boot and Shoe-
-maker the defendant abovenamed George Mott< no role > of North Street Tottenham
Court Read in the Said County Hairdresser and William Russell< no role > of
Princes Street Westminster in the said County Clerk to Mr. Manning Solicitor
for the defendant severally make Oath and say And first the said John
Hardiman
< no role > for himself saith That he pleaded at the last Session to the
above Indictment found against him the Session before last and was bound
in Recognizance to try the same at the present Session And this deponent
further saith That John Dickinson< no role > of No. 3. Warren Street Tottenham Court
Road in the said County Painter and Glazier is a material Witness for him
this deponent on the Trial of this Indictment as he is advised and verily
believes to be true and that he cannot Safely proceed to the Trial thereof
without the Testimomy of the said John Dickinson< no role > And this deponent further
saith That he really intended to take his Trial at the present Session and
in order thereto caused his Solicitor to serve Notice thereof on the Prosecutor
Mathew Swift< no role > , to take out a Subpoena for his Witnesses and to prepare for
Trial but the said John Dickinson< no role > cannot now be found as this deponent
is informed and verily believes And this deponent William Russell< no role >
for himself saith That he did on the Thirteenth day of February instant
serve a ture Copy of the Notice of Trial hereto annexed ( marked A ) on
Mr. Mathew Swift< no role > the Prosecutor by leaving the same with his wife at
the House of the Said Mathew Swift< no role > in the Strand And this deponent William
Russell
< no role > further saith That he did on the Fifteenth day of February instant
Serve a true Copy of the Countermand of Notice of Trial and Notice of
Motion hereto also annexed ( marked B. ) on the said Mathew Swift< no role > by
leaving the same with his Son at the House of the said Matthew Swift< no role > situate
as aforesaid And this deponent George Mott< no role > for himself saith That he
this deponent at the request of the defendant did on Friday the fifteenth
day of February instant go to the House of the said John Dickinson< no role > situate
as aforesaid with intent to serve him with a Copy of the Subpoena so issued
out by the defendants Solicitor as aforesaid And this deponent there saw the
Wife of the said John Dickinson< no role > who informed this deponent and which
Information this deponent verily believes to be true that said John
Dickinson
< no role > was gone out of Town on business into various parts of the
County of Stafford and that the said John Dickinson< no role > would not be in
London
