for Petty Larceny

James Bremmer< no role > of the Turks head in the Stay Market in the
Parish of Saint James in the County of Middlesex Victualler maketh
Oath that he was bound in a Recoginzance to prosecute the
above Deponent in February Session last and saith the attended at
the rotation Office in East Smithfield where he was told by a person
who appeared to be and whom Deponent deliver to be the Clerk to Mr Smith the Justice there that he this
Deponent might take back his property without any danger
or fear and that it would never come to any further hearing
And this deponent saith He wholly Relyed on the advice given
him by the said Clerk and therefore resled perfectly Secure that
nothing would happen from his non Attendance to Prosecute the
said Defendant, nor should he have appeared at the present Session
if he had not received a letter from the Clerk of the Peace purporting
that his said Recognizance would be Estreated if he did not apply to
this Honorable Court for a Stay of Proceedings and its Deponent
further Saith he did not Wilfull neglect to appear and prosecute
the said Defendant nor from any favour or affective that he
hath or beareth towards the said Defendant but merely for
the reason Afroesaid
