WHEREASMarke Richardson< no role > a Prisoner in the
Custody ofI Simon Penn< no role > Keeper of Their Ma-
jesties Gaol ofFinsbury in the saidbond
hath petitioned meWilliam James< no role > Esqr
one of their Majesties Justices of the Peace for the saidCounty
to be discharged our of the said Prison pursuant to two several Acts
of Parliament, one made in the 22th and 23th years of the Reign of our late Sovereign
Lord King Charles II. Intituled, An Act for the Relief and Release of poor distressed Pri-
soners for Debt: The other made in the 30th year of the said late King, Intituled, An
Act for the further Relief and Discharge of poor distressed Prisoners for Debt: And according
to the true intent and meaning of an Act of this present Parliament, Intituled, An Act
for the Relief of poor Prisoners for Debt or Damages: In and by which said Petition, he the
saidprisonersdid set forth, That he now is, and upon
the 28th day of November last past was, Detained and Charged in the same Prison, at
the Suit of several Persons, forDebt & damageswithin the Benefit
and Relief of the said several Acts. And the saidprisoners
being this day brought before me by the saidSimon Penn< no role > Keeper
of the said Gaol , who hath Sworn that the saidprisoners
was really and truly a Prisoner in his Custody, without any Fraud or Deceit by him, or
by any other to his Knowledge, at or upon the said 28th day of November last past : And
the saidprisonershaving likewise Sworn, that on the said
28th day of November he was actually a Prisoner in the Custody of the Gaoler or Keeper
ofFinsburyPrison in theboundofMiddx
at the Suit ofNathaniell Keyes< no role > for debt & damages
without his Consent or Procurement, or by any Fraud or Collusion whatsoever. And
that he the saidprisonershath not any Estate Real or Per-
sonal, in Possession, Reversion, or Remainder, to the value of Ten Pounds in the whole,
or sufficient to pay the Debts or Damages for which he the saidprisoners
is imprisoned; and that he hath not directly or indirectly fold,
leased, or otherwise conveyed or disposed of, or intrusted all or any part of his Estate,
thereby to secure the same, to receive or expect any Profit or Advantage thereof, or
defraud or deceive any Creditor or Creditors whatsoever, to whom he stands indebted,
and that thereupon the saidprisonerprayed to have the Benefit
of the said Acts. These are therefore, by virtue of the said several Acts of Parliament, to
require and appoint, as well the said Prisoner, as also all and every the said Creditor or
Creditors, at whose Suit the said Prisoner is Charged, and all and every other Person or
Persons to whom the said Prisoners stands Indebted or Obliged for any other Cause or
Thing whatsoever, and also the Executors or Administrators of the said Creditors who are
Deceased, to appear before their Majesties Justices of the Peace of the saidCounty
at the next General Quarter-Sessions of the Peace to be holden for the saidCounty
then and there to shew Cause why the said Prisoner should not be
Discharged according to the intent and true meaning of the said Acts. Given under my
