Whereas Edward Reynolds< no role > Gentleman one of the Clerks of Indictments
in this Court and Courts of Oyer and Terminer under James Waller< no role > Esquire
Clerk of the Peace of this County Did on Monday the Ninth day of this Instant
the first day of this Present Session Exhibit a Memorial in Writing Setting
forth among other things that he had Transacted that business ever since
October Session One thousand Seven hundred and Sixty two that within a
short time of September Session last the said Mr. Waller sent for him and
in the Presence of one Mr. George Theakston< no role > told him that he had Appointed
the said Theakston to Succeed Mr. Higgs who (Theakston) had agreed to give
him One Shilling out of every Indictment and that he expected the
Memorialist would allow him the same in future and also Account with
him after the same Rate for the time past and that he the Memorialist had
refused so to do for the reasons mentioned and upon his Application to the
Court at the said last Session for direction whether he should go into the
Office or not and was directed to Officiate till further Order of the Court And
further Setting forth a Letter of Dismission received from Mr. Waller dated
the Twenty ninth day of November last and the Memorialist Answer
thereto And Alledging that the Memorialist having accomplished himself
for the Employment at a Considerable expence of Money and time in
manner therein mentioned and setforth is desirous to continue therein upon
the Terms setforth in the Table of Fees and praying the Protection of the
Court And Whereas the said James Waller< no role > being present in Court
proposed and undertook to Answer the Matters contained in the said
Memorial upon this Present Thursday and for that end and purpose the
said Edward Reynolds< no role > was directed by the Court there at the request of the
said James Waller< no role > (after having perused the same) to make and deliver
him a Copy thereof Now upon hearing of the said James Waller< no role > and his
Council learned in the law who Objected or Declined giving any Answer in
Writing to the said Memorial and Alledging in Effect that it was a matter of
dispute as well between the said James Waller< no role > and Mr. James Jefferson< no role > his
Deputy as the said Edward Reynolds< no role > and therefore proposed that such
Disputes between the said Parties should be submitted to the Arbitrament of
Seven of His Majestys said Justices (three of whom to be named by the said
James Waller< no role > other three by the said James Jefferson< no role > with the concurrence
of the said Edward Reynolds< no role > and one other by the Court here) or any four or
more of them It is thereupon thought fit and by the Consent of all the parties
accordingly Ordered and directed that it be and it is hereby and by and with
the Consent as well of the said James Jefferson< no role > as of the said Edward Reynolds< no role >
recommended and referred to George Errington< no role > John Adam< no role > Frederick Hesse< no role >
