severally make oath and say
and first this Deponent William Rough< no role >
for himself saith that he
is the Prosecutor of the above Indictment agt. the Defendant for
Willfull and corrupt Perjury and at this Present Sessions did cause
Suppoena's to be issued out of this Honourable Court to compell the
Attendance of Witnesses to prove the facts in the said Indictment
Charged and particularly of Edward Benton< no role >
Esquire
the Master of
the Kings Bench office
who is a material Witness for this Deponent
on the Part of the Prosecution and without whose testimony
this Deponent is advised and verily beleives the same to be true
that he cannot safely proceed to the tryal of this Indictment and
that he has endeavoured to procure the Attendance of the said
Edward Benton< no role >
but is informed and verily believes the same to
be true that the said Edward Benton< no role >
is ill as his house in the
Country and cannot attend but believes he shall be able to procure
his Attendance to give Evidence in this Court at the next
Sessions and this DeponentWm.
